1. Services Provided
Text2MD™ is a telemedicine practice operated by Dr. Miguel Antonatos, providing secure messaging-based health care consultations.
Text2MD™ does not interfere with the practice of medicine. Dr. Antonatos is solely responsible for the medical care provided and for compliance with all requirements applicable to his professional license.
NOT FOR EMERGENCIES. Text2MD™’s Site and Services are not for medical emergencies or urgent situations. Do not disregard or delay seeking medical advice based on anything on this Site. IF YOU THINK YOU HAVE AN EMERGENCY, CALL 911 IMMEDIATELY.
Your interaction with Text2MD™ is not intended to replace your relationship with your existing primary care physician. Text2MD™ is not an insurance product. We reserve the right to decline care for actual or potential misuse of the Services. These Terms of Use apply to your registration for and use of the Text2MD™ Services.
2. Prescription Policy
Dr. Antonatos may prescribe medications when medically indicated, in his sole professional judgment. Due to varying state laws, some prescriptions may not be available in your state. Text2MD™ is not a drug fulfillment warehouse, and issuance of a prescription is never guaranteed.
Prescriptions for DEA-controlled or scheduled substances, and certain other high-risk medications, are not available through the Text2MD™ platform.
Any prescription you receive is for your personal use only. Read all provided product information and labeling, and contact a physician or pharmacist with any questions.
3. Informed Consent
A. What telemedicine is. Telemedicine is the delivery of health care using technology, where the patient and physician are not in the same physical location. During your consultation, your medical history and personal health information will be discussed and exchanged through Text2MD™’s secure messaging platform.
You may be asked to provide identity verification (such as a driver’s license) depending on your specific situation.
B. Limitations. Telemedicine through Text2MD™ is not intended to replace a primary care relationship or be your permanent medical home. Seek emergency help or follow-up care as recommended by Dr. Antonatos or as otherwise needed, and continue seeing your primary care physician and other providers as appropriate. If you experience a technical disruption during your consultation, contact support and we will help you reconnect. You have access to support to follow up on medication reactions, side effects, or other adverse events.
Risks of telemedicine include, but are not limited to:
- Information transmitted may sometimes be insufficient for full clinical decision-making (e.g., limited image quality)
- Delays in evaluation or treatment due to technical issues
- Incomplete access to your full medical history may affect clinical judgment
- Despite reasonable security safeguards, a breach of privacy or health information is possible
C. By using Text2MD™, you acknowledge:
- Telemedicine may offer real benefits, but no specific outcome is guaranteed
- Privacy and security laws applicable to health information apply here, as described in our Notice of Privacy Practices
- You are responsible for payment
- Dr. Antonatos may, in his professional judgment, determine that telemedicine is not appropriate for some or all of your treatment needs, and may decline to provide care through this platform
4. Account Enrollment, Eligibility, and Security
To use the Site, you confirm you are of legal age to enter a binding contract (or are a parent/legal guardian registering on behalf of a minor child), and agree to provide accurate, complete registration information. You are solely responsible for the confidentiality of your login credentials and all activity under your account. Notify us immediately at support@text2md.com of any suspected unauthorized use.
Parents/guardians may register dependents under their own account; dependent subaccounts are subject to these Terms and our Notice of Privacy Practices.
We may monitor use of the Site to determine compliance with these Terms, and may suspend or decline service for noncompliance or suspected misuse. We recommend avoiding use of the Services from public/shared computers.
5. Fraud Prevention and Security
We may contact you to verify your account information. If requested information isn’t provided within 14 days, we reserve the right to suspend or deny access until it is.
6. Modifications to These Terms
We may update these Terms at any time. The current version is always available on this page. Continued use of Text2MD™ after a revision constitutes acceptance of the updated Terms.
7. Information Provided by You
You’re required to provide accurate personal and medical information at signup, and to keep it current. Time-sensitive information (including medical information, diagnoses, and results) may be sent to the email address you provide — choose your contact email accordingly. You’re responsible for promptly notifying us of changes to your contact information, payment information, or health insurance details.
8. Electronic Medical Record
Your Text2MD™ record includes your medical history, current conditions, symptoms, allergies, medications, and Dr. Antonatos’s documentation of each encounter, maintained in accordance with applicable law. You agree to keep your information accurate and current. See our Notice of Privacy Practices for details on how this information is used and protected. It’s your responsibility to confirm the accuracy of any third-party or dependent information you submit. By requesting a consultation, you agree to disclose your complete record to the physician conducting it.
9. Limitations on Use
You agree not to use the Site unlawfully, impersonate another person, misrepresent your identity, or allow anyone else to use your account. You agree not to attempt to compromise the security or integrity of Text2MD™’s systems, harvest PHI belonging to other users, transmit harmful code, or use automated tools (bots/scripts) against the Site. You agree not to reverse-engineer any part of the Services, and to keep appropriate anti-virus/anti-spyware protection active on devices you use to access the Site.
You agree that your use of the Site will not infringe any copyright, trademark, trade secret, or other proprietary right of any party.
10. Operational Functionality
Text2MD™ may modify, suspend, or discontinue any feature of the Services at its discretion. We are not responsible for transmission errors caused by third-party telecommunications carriers, and are not responsible for maintaining information beyond what is required by law.
11. Intellectual Property
Except for your own medical record, Text2MD™ retains all rights to the Site, Services, and related content, software, and materials. You agree not to copy, reverse-engineer, resell, sublicense, or create derivative works from the Services. Disputes regarding intellectual property or these Terms will be handled in the federal and state courts located in Illinois.
12. International Use
The Services are designed for users in the United States. We make no representation that content or Services are appropriate for use outside the U.S. Accessing the Services from jurisdictions where such access is illegal is prohibited.
13. Legal Notices and Disclaimers
General Disclaimer. Your use of Text2MD™ Services is at your sole risk. All information, products, and services are provided “as is” and “as available,” without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Text2MD™ makes no warranty regarding the reliability, accuracy, timeliness, or completeness of the Services, nor regarding compliance with regulations concerning prescription drug disclosures.
Medical Disclaimer. Text2MD™ makes no representation as to the content of any treatment response. You and Dr. Antonatos are solely responsible for communications exchanged during a consultation. Text2MD™ does not guarantee that a telemedicine consultation is the appropriate course of treatment for your condition, and telemedicine is not a substitute for a primary care relationship. Contact your physician immediately if your condition changes or worsens; contact emergency services for urgent needs. Text2MD™ itself does not provide medical advice, diagnosis, or treatment — it provides the technology platform connecting you to your treating physician.
Content Disclaimer. Nothing on this Site should be relied upon as professional medical advice or construed as the practice of medicine by Text2MD™ itself. Content is general educational material only. Always consult a physician before starting, stopping, or changing any treatment, medication, or supplement regimen. Never delay seeking medical advice because of something read on this Site.
14. Service Reliability
Text2MD™ does not warrant that the Services will be uninterrupted, timely, fully secure, or error-free. We take commercially reasonable precautions against system failure, but are not liable for temporary interruptions, data loss, or delays in data restoration from backup.
GENERAL WEBSITE INFORMATION
Nothing on this Site is intended to recommend self-management of a health condition or endorse a specific treatment. If you have health-related questions, consult your physician or another qualified healthcare provider promptly. Do not use information on this Site to initiate use of supplements, vitamins, herbal products, or homeopathic remedies without first consulting a physician.
REFUND POLICY
Your consultation fee is nonrefundable once your prescription has been sent to the pharmacy. Fee amount is not affected by your medication cost or insurance coverage. You will be fully refunded if we are unable to treat you. If your pharmacy reports they don’t have your prescription on file, email support@text2md.com immediately and we will resend it — refunds are not available for missing prescriptions that aren’t reported promptly. To request a refund, email support@text2md.com.
