Notice of Privacy Practices

This Notice describes how medical information about you may be used and disclosed, and how you can get access to this information. Please review it carefully.

Personally identifiable information about your health, your health care, and your payment for health care is called Protected Health Information (PHI). We must safeguard your PHI and give you this Notice about our privacy practices, explaining how, when, and why we may use or disclose it. Except as set out in this Notice, we will use or disclose only the minimum necessary PHI to carry out the use or disclosure.

We must follow the practices described in this Notice, but we may change our privacy practices and the terms of this Notice at any time. If we revise the Notice, the updated version will be posted on our website at portal.text2md.com and available upon request. You may also ask for a copy by contacting us at the information below.


Uses and Disclosures That Do Not Require Your Consent

We may use and disclose your PHI as follows, without your permission:

For treatment purposes. We may disclose your health information to physicians, pharmacies, laboratories, or other providers involved in your care — for example, sending a prescription to your pharmacy or sharing lab results with you.

To obtain payment. We may disclose your health information to collect payment for your care, such as releasing information to your insurance company or payment processor.

For health care operations. We may use or disclose your health information to perform business functions such as quality review, staff training, and improving our services. We may use your contact information to remind you of a pending consultation or follow-up.

When required by law. We may be required to disclose your PHI to law enforcement, courts, or government agencies — for example, to report abuse, neglect, or certain injuries.

For public health activities. We may report health information to government agencies to help prevent or control disease or injury, or to report work-related illness or injury as required.

For health oversight activities. We may disclose health information to government agencies responsible for licensing and monitoring health care providers.

For activities related to death. We may disclose health information to coroners, medical examiners, or others carrying out legally required duties related to a patient’s death.

To avert a threat to health or safety. We may disclose health information to prevent or lessen a serious, imminent threat to health or safety.

For specific government functions. In certain situations, we may disclose health information related to military and veteran affairs, correctional facilities, government benefit programs, or national security.

For workers’ compensation purposes. We may disclose health information to government authorities as required under workers’ compensation laws.

For fundraising purposes. [Confirm applicability] We may use limited information (such as name, contact details, and dates of service) to send fundraising communications. You may opt out at any time by contacting our Privacy Officer, and opting out will not affect your care.


Uses and Disclosures That Require Your Written Consent

The following will be made only with your written permission, which you may withdraw at any time:

For research purposes beyond what’s described above.

For marketing purposes. We will not use or disclose your PHI to market products or services to you without your permission, and we will never sell your PHI.

Of clinical notes. We will not disclose your physician’s private clinical notes without your permission, except as required by court order or for the treating physician’s own use.

For any other purpose not described in this Notice.


Your Rights Regarding Your Protected Health Information

To inspect and receive a copy of your PHI. You may request a copy of your health information, including in electronic format, through your patient portal account or by contacting us directly.

To request a correction. If you believe your health information is incomplete or incorrect, you may ask us in writing to correct it. We will respond to your request and explain our decision.

To request a restriction on use or disclosure. You may ask us to limit how we use or share your information. We are not always able to agree, except where required — for instance, restricting disclosure to a health plan for services you’ve paid for in full out of pocket.

To request confidential communications. You may ask us to contact you in a specific way or at a specific address, and we will accommodate reasonable requests.

To receive an accounting of disclosures. You may request a list of certain disclosures of your PHI made in the past six years. We will respond within 60 days.

To be notified of a breach. We will notify you if your PHI is acquired, accessed, used, or disclosed in a manner not permitted by law, as required by applicable breach notification rules.

To receive a paper copy of this Notice. You may request a paper copy at any time, even if you’ve agreed to receive it electronically.

How to File a Complaint
